Terms of Service
These Terms govern your access to and use of our website, products, and services. Please read them carefully — by using our Services, you agree to be bound by these Terms.
1 Agreement to Terms
These Terms of Service ("Terms") form a legally binding agreement between you ("you", "Customer", or "User") and MyOffshore ("we", "us", or "our") regarding your use of the website myoffshore.host and any related products, services, and features (collectively, the "Services").
By accessing our website, creating an account, or purchasing any Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use our Services.
2 Definitions
- "Account" — the registered profile you create to access and manage the Services.
- "Services" — all products, plans, and features we provide, including any add-ons.
- "Content" — any data, files, text, images, or other material you upload, store, or transmit through the Services.
- "Order" — a request to purchase or renew a Service placed through our website or billing portal.
3 Eligibility & Account Registration
To use our Services, you must be at least 18 years old (or the age of legal majority in your jurisdiction) and able to enter into a binding contract. You agree to provide accurate, current, and complete information when registering and to keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use or security breach. We are not liable for any loss arising from your failure to protect your credentials.
4 Services & Delivery
We will provide the Services described in your Order in accordance with these Terms. Service delivery, provisioning times, and specifications may vary by plan and are described on the relevant product page or Order form.
We continuously work to improve our Services and may, from time to time, modify, enhance, or discontinue certain features. Where a change materially affects a Service you are paying for, we will make reasonable efforts to notify you in advance.
5 Fees, Billing & Renewals
- Pricing — fees are those displayed on your Order form or product page at the time of purchase. Prices may change for future terms, with notice before renewal.
- Payment — invoices are due by the date shown on the invoice. Services may be suspended if payment is not received by the due date.
- Automatic renewal — unless cancelled, Services renew automatically for the same term, and the applicable renewal fee will be charged. You may disable renewal at any time from your billing portal.
- Taxes — fees are exclusive of applicable taxes, which will be added where required by law.
- Promotions — coupons and promotional codes may apply only to specific plans and cannot be combined unless stated otherwise.
6 Refunds & Money-Back Guarantee
Where offered, a money-back guarantee applies within 14 days of the initial purchase for eligible plans. To request a refund, contact us within the eligible period through your billing portal or support channel.
- Refunds apply only to eligible Services as stated on the product page; certain Services (for example, dedicated resources, licenses, domain registrations, and setup fees) may be non-refundable.
- Renewals, upgrades, and add-ons purchased after the initial term are generally non-refundable unless required by law.
- We reserve the right to decline refunds in cases of abuse, fraud, or violation of these Terms.
7 Acceptable Use Policy
You agree not to use the Services for any unlawful, harmful, or abusive purpose. The following activities and content are strictly prohibited:
- Any content that exploits or endangers minors, or any illegal material;
- Phishing, fraud, scams, identity theft, or deceptive practices;
- Distributing malware, viruses, or engaging in hacking, unauthorised access, or denial-of-service (DoS/DDoS) attacks;
- Sending spam or unsolicited bulk email in violation of anti-spam laws;
- Infringing intellectual property rights or distributing pirated material;
- Hosting content that is defamatory, harassing, or that incites violence or hatred;
- Any activity that compromises the security, stability, or integrity of our network or that of others.
8 Resource Usage & Fair Use
Each plan includes allocated resources such as storage, bandwidth, and processing capacity as described on the product page. You agree to use resources fairly and within the limits of your plan.
Excessive use that adversely affects other customers or the stability of shared infrastructure may require an upgrade, incur additional charges, or result in limitation of the Service. Reselling or sharing account resources outside the terms of your plan is not permitted without our prior written consent.
9 Backups & Data Responsibility
While we may provide backup features, you are solely responsible for maintaining your own independent backups of your Content. We do not guarantee the availability, accuracy, or completeness of any backup and are not liable for any loss of data.
You are responsible for all commands, configurations, scripts, and changes executed on your account or servers — including those generated with the assistance of automated or AI tools. We disclaim liability for any instability, downtime, or data loss resulting from changes you initiate.
10 Suspension & Termination
We may suspend or terminate your access to the Services, in whole or in part, if:
- You fail to pay fees when due;
- You breach these Terms or the Acceptable Use Policy;
- Your use poses a security, legal, or operational risk; or
- We are required to do so by law.
You may cancel your Services at any time through your billing portal. Upon termination or cancellation, your access will cease and your Content may be permanently deleted. Please export any data you wish to keep before cancelling.
11 Intellectual Property Rights
All rights, title, and interest in the Services — including our website, software, technology, trademarks, logos, and content we create — remain our exclusive property or that of our licensors. You may not copy, modify, reverse engineer, decompile, resell, or create derivative works from any part of our Services except as expressly permitted.
You retain ownership of the Content you upload. By using the Services, you grant us a limited licence to host, store, and process your Content solely to provide and maintain the Services.
12 Third-Party Services
Our Services may rely on or link to third-party products, software, or platforms. Your use of such third-party services is governed by their own terms, and we are not responsible for their availability, performance, or practices.
13 Disclaimers & Warranties
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, or completely secure. Any service-level commitments, where offered, are set out separately in an applicable Service Level Agreement (SLA).
14 Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services.
In any event, our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid to us for the relevant Service during the three (3) months preceding the event giving rise to the claim.
15 Indemnification
You agree to indemnify, defend, and hold harmless MyOffshore, its owners, employees, and partners from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your Content, or your violation of these Terms or any applicable law.
16 Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, business practices, or legal requirements. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
17 Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands, unless otherwise required by applicable law.
Before pursuing formal action, we encourage you to contact us so we can try to resolve the matter informally.
